Couple want divorce so they can get married again

A couple who have been married for more than 40 years are appealing to the Family Court to have their union declared invalid so that they can tie the knot again. In the application to the court, the woman said she had received “guidance from God” telling her the marriage is illegitimate.

She believes the marriage, which took place in 1970 before 100 guests, is not legal because one of the witnesses who signed the documentation was her 16-year-old bridesmaid. The Marriage Act states the two witnesses to the marriage must be aged 18 and over.

The wife said she wants to get rid of “the illegitimacy (of the marriage) hanging over her family”.

“The wife states that she ignored the instructions from the minister about having two witnesses over 18 years of age sign the Certificate of Marriage,” Justice Michelle May said when deciding whether to allow them to lodge an appeal.
